So if I took an oath, I swore by the
name of Allah to do something,
then I decided not to do it or I didn't
do it.
I have to expedate as per the ayah 589
chapter 5 verse 89.
Allahel
tells us that whoever breaks his oath
has to do one of three.
And if he's financially unable to do one
of these three things then he has to go
for the alternative which is to fast
three days. Now breaking an oath
also includes when someone prohibits
something upon himself. So for example,
if I say to myself,
I will not
eat
garlic from now on. Garlic is haram on
me from now on. Now I made something
haram upon myself
which Allah did not make haram upon upon
me. Which means I prohibited something
which is not prohibited to me. Not that
I made it haram in Islam rather I
prevented myself from consuming it.
This is similar to taking an oath
because Allahawel
says in
oh prophet of Allah sallallahu alaihi
wasallam why do you prohibit yourself
from what Allah has made lawful for you
seeking the approval of your wives and
Allah is forgiving and merciful. Allah
has already ordained for you Muslims the
the solution the dissolution of your
oath. So you dissolve your oaths when
you make something haram for yourself.
So taking an oath or making something
haram for yourself and going back on it
you have to expedate. So how to
experiate? Well,
the prophet sallallahu alaihi wasallam
the thing that he made haram for himself
is that he would not eat a certain type
of honey
because as in in some of the stories
interpreting this incident,
the wives of the prophetam plotted
whenever he came to them from another
third wife
house, they would say, "Oh, there's a
smell coming out from your mouth." And
he would say, "I had nothing except this
kind of honey
which he liked to eat at that third
wife's house." So they plotted
against the prophet so that he would not
visit that third wife and eat that honey
at her house. So he made it haram for
himself. Allahawel
told him to experiate. So what is the
experation? As mentioned in verse 89,
one
is to feed
10 poor people.
An average meal
from what we feed our own families.
one average meal for each person, 10
different poor people, or dressing them,
giving them the
uh um
proper attire to wear
or to free a slave.
Now these are all
financial
um experation
either you feed 10 poor people from the
average of which you feed your own
families or to clothe them or to free a
slave. If you can't because you don't
have the financial means you have to
fast three days.
Most of the people have it reversed.
Whenever they break an oath, they just
go for fasting. No, what you can choose
of are these three financial
experiations.
Either you feed or you clothe or you
free a slave. Pick your pick. It's up to
your preference.
If you're unable, then you resort to the
alternative, which is to fast three
days. And do we have to fast them in
sequence
simultaneously?
Some companions like Abdullah
said that this is recommended but the
most authentic opin opinion is that you
are not obliged to do this. When to
offer the expeation? You have a choice.
either expedate
before you break your oath or after you
break the your oath. The hadith of the
prophet wasallam indicated both as a
choice.
So the prophet told us when he wants to
do something he would do what is best
and then expedate.
And in another hadith he says if you
swear an oath and do something that uh
then realize if you swear an oath to do
something then realize that something
else is better than it then do what is
which better and offer uh an experation
for breaking your oath. And in another
hadith the prophet said uh the opposite.
He said that uh uh break or experate for
breaking your oath then you can do what
is better. Either way is totally fine
with the grace of Allah.
So there is leniency in this.
Alhamdulillah.
What's the ruling on breaking an oath?
Well, it is a sunnah when you see
something that is better. So if you for
example
want to do something that is disliked
and you take an oath over it, then you
realize that no, this was disliked. It's
best for me not to do it. Then it is
sunnah for you to break it. Or if you
wanted to
skip something that is sunnah
and then said wow why would I do that
such a thing so it is highly recommended
for you to skip it secondly it is
mandatory
to break your oath if you took an oath
not to do something which is mandatory
wall I will not pray in the masid
uh uh today
it's not up to you. It's mandatory. It
is mandatory in this case for you to
break your oath and expedate or wall I
will drink uh uh intoxicants.
It's haram. It's a major sin. You have
to break your oath and not drink any
intoxicants and and also offer the
expeation.
And thirdly, it can be permissible.
It can be permissible to break your oath
when you swear over permissible things.
Wah, I will not wear yellow
t-shirts from now on.
I will not jog in the morning. These are
permissible things. Whether you do them
or not, it's up to you. So if you want
to break your oath there is no problem
in that and then you expedate.
Then we move on to a more serious issue
and that is found in a lot of cultures
Arabs and non-Arabs and that is to swear
to take an oath with other than the name
of Allahawel
and is totally prohibited and it's a
major sin and it can take someone out of
the fold of Islam. So it's either minor
shik or major shik such as when people
say by the prophetam
they swear by the name of the prophetam
in Arabic they say
or by your life
or by my mother's life
with my father's head
by the grave of uh so and So by maana
tani or gilani ori
by my honor by al hussein by al am by
thea and the and the likes the prophet
saysam
whoever swears by other than allahawel
then he has associated others with him
the almighty this is shik he has
committed shik and in Bkari and Muslim
the prophet sallallahu alaihi wasallam
heard rumor may Allah be pleased with
him swearing by his father
and that was what the Arabs used to do
and still do till date unfortunately.
So the prophet shouted at them saying,
"Allah the Almighty prohibits and
forbids you to swear by your fathers.
Whoever must swear, let him swear by
Allah or else remain silent." Omar said
by Allah. Since then I never swore by
other than Allahawel.
And also the prophet said sallallahu
alaihi wasallam do not swear by your
fathers or by your mothers or by the
idols. Do not swear by anything except
by Allah and do not swear except when
you are telling the truth. So swearing
is a serious thing. Unfortunately
nowadays people take it lightly.
And in in Arabic we have a saying
when the thief
is caught with his hand in the cookie
jar as they say with when the thief is
caught red-handed
and he said I didn't swear I I didn't
steal anything and the judge say swear
by Allah you did not steal anything.
People say to the thief, "Alhamdulillah,
now you will be set free." Knowing that
he will swear by Allah and lie without
any hesitation or any fear of that.
May Allah have mercy on him. The great
companion of the prophet sallall alaihi
wasallam says to swear by Allah falsely
is dearer and better to me than to swear
by anything else truthfully.
Subhan Allah. to take an oath and lie
while taking the name of Allah.
It's better and dearer to me than to
swear by other than Allah when I'm
telling the truth. Because when you're
telling the truth and taking other than
the name of Allah, you're committing
shik, which is a major uh the one of the
major sins in Islam.
While if you take the name of Allah and
lie that is a major sin but it's a sin
nothing compared to

is better than any good deed of truth.
So never ever say the truth while
associating it associating it with other
than the name of Allah because that
would be shik and always remain with
even if you associate it with a sinful
act like lying and Allahel knows best.
